Welcome to VamoGo! By using our website, app, and services, you agree to the following Terms of Service and Disclaimers. Please read them carefully. If you do not agree with any part of these terms, you should not use our service.
1. Eligibility
• You must be at least 18 years old to use VamoGo.
• By placing an order, you confirm that the information provided is accurate and that you have the legal right to make purchases.
2. Service Description
VamoGo is a delivery service that provides:
• U.S. Grocery Delivery – We source and deliver popular American grocery items to customers in Baja California (between KM38 and KM78), Mexico.
• Local Store & Restaurant Delivery – Customers can place orders for products from local stores, supermarkets, and restaurants, and VamoGo will pick-up and deliver the order.
3. Product Listings & Availability
• The products displayed on our website represent items we frequently have access to but do not guarantee immediate availability.
• Some items are stocked in our dark store for immediate delivery, while others require pre-ordering through our Concierge service.
• VamoGo does not pre-purchase and store all listed products. Some items are purchased only after the customer places an order, subject to availability from our sourcing store.
• If an item is unavailable at the time of your order, we will notify you and may offer an alternative, cancellation, or refund for that item at our discretion.
• We do not guarantee substitutions if an ordered item is unavailable, but refunds are guaranteed.
Concierge Pre-Orders vs. On-Demand Orders
• On-Demand Orders – These are stocked in our dark store and available for immediate delivery (subject to availability).
• Concierge Pre-Orders – These are sourced upon request and require pre-ordering for weekly delivery. Customers will be notified of estimated arrival times.
4. Ordering & Pricing
• Prices are subject to change without notice due to supplier pricing, exchange rates, or demand.
• VamoGo does not control pricing from third-party stores or restaurants. Prices are set by each vendor and may include additional service fees.
• We are not responsible for order mistakes, missing items, or food quality from local restaurants or stores. Customers should contact the local vendor directly if there is an issue with an item.
• Product availability is not guaranteed, as inventory depends on suppliers and third-party vendors.
• Customer data may be used to improve the platform and ensure service quality
• Purchase Limits: Customers may buy a maximum of three (3) of the same item per order to help ensure availability for all customers.
5. Delivery Policy
Delivery Areas
• VamoGo currently serves customers between KM 38 and KM78.
• We only deliver to paved roads with a maximum distance of 1 kilometer off of the main free road.
• Delivery times depend on demand, weather, traffic, and vendor operations. Delays may occur.
• Orders from local stores and restaurants are subject to each vendor’s hours and availability.
Delivery Pricing
• Delivery pricing is subject to change at any time due to a variety of factors, including but not limited to:
• Changes in fuel prices
• Adjustments in local taxes or fees
• Traffic conditions or road closures affecting delivery routes
• Changes in vendor pricing or delivery fees from third-party stores or restaurants
• Demand fluctuations, such as high order volumes during peak hours or seasons
• Location data may be used to adjust delivery pricing and determine the service area, as outlined in the Privacy Policy.
VamoGo reserves the right to modify service areas, delivery times, and policies at any time.
6. Refund & Return Policy
Grocery & Product Deliveries:
• Due to the nature of perishable goods, all sales are final.
• If you receive a damaged or incorrect grocery item, contact us via WhatsApp chat on our website within 24 hours of delivery with a description and photo of the issue. We will review your request and may issue a replacement or store credit at our discretion.
7. Limitation of Liability
• VamoGo provides its service as-is and does not guarantee uninterrupted, error-free service.
• We are not responsible for delays, product shortages, or supplier limitations affecting availability.
• VamoGo is not liable for circumstances where an ordered item is no longer available at the time of purchase from our sourcing store.
• By using our service, customers understand that some products require pre-ordering, and immediate availability is not guaranteed unless explicitly stated.
• Customers understand that VamoGo is an independent service not affiliated with or authorized by any U.S. retailer.
• Customers agree not to attempt to return products purchased through VamoGo to any U.S. store or vendor. All sales are final; we will not provide receipts from the original U.S. retailer.
• We are not liable for any direct, indirect, incidental, or consequential damages related to your use of our service.
• Customers assume all risks when consuming food or using purchased products, especially if they have allergies or dietary restrictions.
• All concerns regarding product quality, accuracy, or other issues must be addressed directly with VamoGo. We will resolve order concerns, but VamoGo is the sole point of contact for handling product issues, not the original retailer.
8. Third-Party Trademarks & Affiliation
• All product names, trademarks, and brands displayed on our website are the property of their respective owners.
• VamoGo is not affiliated with, endorsed by, or sponsored by any grocery retailer, restaurant, or store.
• Any references to specific products or brands are for informational purposes only to describe available items.
9. Privacy & Data Collection
VamoGo is committed to protecting your privacy.
• We collect customer data only for order processing, delivery coordination, and service improvements.
• We do not sell, rent, or share your personal information with third parties without your consent, except as required by law.
• By using VamoGo, you agree to receive order updates and promotional communications. You can opt out at any time.

10. Subscription & Pre-Order Terms (VamoGo Concierge)
• The VamoGo Concierge service allows customers to pre-order U.S. groceries for weekly delivery.
• Orders are final once placed, and modifications are not possible. Contact us within 30 minutes of placing your order should you need to cancel, but know that cancellation is not guaranteed.
• Subscription fees and delivery charges are non-refundable.
11. User Conduct
You agree not to:
• Misuse our platform, engage in fraudulent activity, or attempt to disrupt operations.
• Provide false information or impersonate another person.
• Violate any applicable laws while using our services.
• Purchase more than three (3) of any given item per order.
• Buy products for resale purposes. If we suspect a customer is purchasing for resale, we reserve the right to cancel orders and prohibit future purchases from that customer.
12. Modifications to Terms
VamoGo reserves the right to update these terms at any time. Changes will take effect immediately upon posting on our website. Your continued use of our service constitutes acceptance of the revised terms.
